1. About us and these Terms
PassPath is operated by PASSPATH (PTY) LTD, a private company registered in South Africa (Registration No. 2026/517551/07). You can contact us at support@passpath.co.za or through our website, www.passpath.co.za. Our registered address is available on written request to support@passpath.co.za, including for the service of legal documents.
These Terms are a legal agreement between you and PASSPATH (PTY) LTD. They apply to the PassPath website and the PassPath web application, and they are written in plain language, as the Consumer Protection Act 68 of 2008 (CPA) requires. By creating an account or purchasing a course, you accept them. If you do not agree with them, please do not register or purchase.
Our Privacy Policy and Refund & Access Policy form part of these Terms. If anything in these Terms is unclear, email us and we will explain it before you buy.
2. The service
PassPath is an online self-study exam-preparation platform for South Africa’s FAIS regulatory exams (currently RE5 and RE1). It offers practice questions, readiness measurement, and exam simulation to help you prepare in your own time.
PassPath is an independent study aid. We are not affiliated with, endorsed by, or acting for the Financial Sector Conduct Authority (FSCA), Moonstone, or any examination body. The regulatory exams themselves are administered separately, and you must book and write them through the official channels. Booking the exam, paying the exam fee, and meeting any regulatory deadlines (such as FAIS date-of-first-appointment deadlines) remain your responsibility.
Our content is educational only. It is not financial, legal, or other professional advice. While we work hard to keep our material accurate and up to date, we do not guarantee that any user will pass any exam. Your result depends on your own preparation and performance on the day.
We update our question bank and study materials from time to time to reflect changes in the qualifying criteria and legislation. If official sources change shortly before your exam, always check the latest official material as well.
3. Your account
- You must be 18 years or older to create an account.
- You must give accurate information when you register and keep it up to date.
- Accounts are limited to one per person and may not be shared. Your purchase licenses you, personally, to use the platform.
- You are responsible for keeping your login details confidential and for all activity on your account. If you think someone else has accessed your account, tell us at support@passpath.co.za right away.
You can close your account at any time by emailing us. Closing your account does not by itself entitle you to a refund — refunds are governed by the Refund & Access Policy.
4. Purchases and payment
Each course is a once-off purchase — there is no subscription, no recurring billing, and no hidden charges. The price shown at checkout is the full, final price you pay. PASSPATH (PTY) LTD is not registered for VAT, so no VAT is charged or shown.
Before you pay, you can review your order, correct any mistakes, and withdraw from the transaction. Payment is only taken once you confirm. After a successful payment, we email you a confirmation and unlock your course; if payment fails or is cancelled, nothing is charged and no access is granted.
Payments are processed by PayFast, a secure South African payment gateway. Your card details are entered directly with PayFast — PassPath never receives or stores them.
If a price is displayed in obvious error (for example, because of a technical fault), we may correct it and offer you the choice of paying the correct price or cancelling the order for a full refund.
5. Access and licence
When you purchase a course, you get access to it for 180 days from the date of purchase. Your purchase gives you a personal, non-transferable, non-commercial licence to use the course for your own exam preparation. It does not transfer ownership of any content to you.
You can use your course on any of your own devices through a web browser, but only under your own account. Access ends automatically when the 180 days expire; there is no auto-renewal and no further charge. If you need more time, you can purchase the course again at the then-current price.

6. Intellectual property
All content on the platform — including practice questions, explanations, study materials, software, and branding — is owned by PASSPATH (PTY) LTD or its licensors and is protected by copyright and other intellectual property laws.
You may not copy, distribute, publish, scrape, resell, or share any of our content, or make it available to anyone else, in any form. This includes sharing questions or answers with other exam candidates, posting our content on other websites or in study groups, and using our content to build or train a competing product.
“PassPath” and our logo are our trade names and marks. You may not use them without our written permission.
7. Acceptable use
You agree not to:
- use the platform for any unlawful purpose;
- circumvent, or attempt to circumvent, any access controls or the payment process;
- access the platform with bots, scripts, or other automated tools, or bulk-download any content;
- share your account or use someone else’s account;
- interfere with the operation or security of the platform, or test it for vulnerabilities without our written permission.
If you breach these Terms — for example by sharing an account, copying content, or bypassing payment — we may suspend or terminate your account without a refund. Where reasonable, we will contact you first to resolve the issue, and suspension or termination does not take away any other legal remedies we may have.
8. Service availability
We make reasonable efforts to keep PassPath available at all times, but maintenance, updates, and events outside our control may cause interruptions. We do not warrant that the service will be uninterrupted or error-free. Where planned maintenance is likely to cause significant downtime, we will try to schedule it outside peak study hours. We may also improve, change, or retire features of the platform over time, provided this does not deprive you of the substance of the course you paid for during your access period.
You are responsible for your own device and internet connection; we are not responsible for problems caused by your equipment or your network provider.
9. Limitation of liability — please read carefully
To the extent permitted by law, PASSPATH (PTY) LTD’s total liability to you for any claim arising out of your use of the platform is limited to the amount you paid us for the course concerned.
In particular, we are not liable for indirect losses — such as lost income, lost opportunities, or the cost of booking or rebooking an exam — or for your exam result, which depends on your own preparation and performance.
This limitation applies as far as the law allows, and no further. Nothing in these Terms excludes or limits our liability for gross negligence or fraud, or any liability that cannot lawfully be excluded or limited under the Consumer Protection Act 68 of 2008 or other South African law. Nothing in these Terms limits your statutory rights as a consumer.
10. Privacy
We handle your personal information in line with the Protection of Personal Information Act (POPIA). Our Privacy Policy explains what we collect, why, and your rights — please read it, as it forms part of these Terms.
11. Changes to these Terms
We may update these Terms from time to time, for example when we add new courses or features or when the law changes. Each version is dated at the top of this page, and the version on this page is the one that applies. If we make a material change, we will notify registered users by email before it takes effect. Continuing to use the platform after a change takes effect means you accept the updated Terms; changes do not apply retroactively to purchases you have already made, except where the law requires it.
12. Communications
By creating an account, you agree to receive service and transactional emails from us — such as purchase confirmations, access reminders, and important notices about your account. We only send marketing emails if you have opted in, and every marketing email includes a working unsubscribe link. Unsubscribing from marketing does not stop the service emails you need to use your account.
13. Complaints and disputes
If something goes wrong, contact us first at support@passpath.co.za and tell us what happened — most issues are resolved quickly and without formality. We aim to respond within two business days. These Terms are governed by South African law, and the South African courts have jurisdiction over any dispute.
If we cannot resolve a consumer complaint, you may refer it to the Consumer Goods and Services Ombud (www.cgso.org.za) or the National Consumer Commission.
